Terms of Service Mine Papirer

These Terms of Service ("Terms") cover your use and access to our Service, client software and websites ("Service", "Services"). The Service is provided by Telenor Software Lab AS ("Telenor Software Lab", "TSL", "we", "us", "our"), a company registered in Norway, with company registration number 884 640 202. Our Privacy Policy explains how we collect and use your information while our Acceptable Use Policy explains how we expect you to use our Service. By using the Service, you agree to comply to these Terms, including our Privacy Policy and our Acceptable Use Policy. By using our Services, you are agreeing to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. Please read these carefully.

Description of the Service

Mine Papirer is an internet based storage service that allows you to store, see and annotate electronic documents. You will be able to add and view these documents on a selection of supported handheld devices.

You own Your Content

When you use our Service, you provide us with your photographs, documents, notes, and other content ("Content", "Your Content"). Your Content belongs to you. These Terms do not grant us any rights to Your Content, except the limited rights required to provide the Service.

We need your permission perform actions with Your Content such as hosting, backing up, and sharing it when you request. The Service provides features such as; but not limited to; sharing, commenting, thumbnails, previews, searching, organisation, and personalisation. To provide these features, we must access, store, scan, or otherwise process Your Content.

We take proactive steps to automatically detect and report Child Sexual Abuse Material (CSAM) in line with industry best practice. Any CSAM will be reported to the Police or other relevant authorities, and your account will be terminated without notice.

We will only provide access to Your Content to you, or other persons legally authorised to access it. If you wish that someone should be able to get access to Your Content in the event of your death, this should be explicitly detailed in your Will.

Paying for the use of the Service

If you purchase a subscription, we will automatically bill you on the date you first subscribe, and on each periodic renewal date until cancellation. You are responsible for all applicable taxes, and we will charge additional tax when we're required to do so. You can cancel your subscription at any time. Your additional storage will remain available until you cancel your subscription, or it is terminated under these Terms. If you fail to pay your subscription on time, we may suspend or remove your extra storage space. We reserve the right to adjust the fees payable on renewal of your subscription to reflect business or economic changes. We will give you ample notice of this, so you can cancel your subscription before the new fee comes into effect, should you wish.

Your Responsibilities

You are responsible for your actions. Your Content and your actions must comply with our Acceptable Use Policy. Content in the Service may be protected by others' intellectual property rights. Please don't copy, upload, download or share content unless you have the right to do so. We may review your actions for compliance with these Terms and our Acceptable Use Policy. With that said, we have no obligation to do so. We aren't responsible for the content people post and share via the Services. We do not access Your Content unless we are required by law or when required to maintain the Service. You are responsible for providing and maintaining accurate and updated personal information, and for safeguarding your account information. To keep Your Content secure you need to protect this with your own password. Due to the sensitivity of Your Content the password should be selected in such a way that other persons cannot guess it. You may not select or use an identity of another person with the intent to impersonate that person. You must use a valid e-mail address, and we reserve the right to verify this at any time. You are not allowed to have more than one account per e-mail address. Please make sure that you log out when using public or shared devices. If you hand over a device with the Service installed to another individual, you should log out of the Service and/or deactivate the device before doing so. If devices with the Service installed are lost or stolen, you should change the password immediately and contact customer Service to remotely log out your devices. Don't share your account credentials or give others access to your account. We will not be liable for any loss or damage arising from your failure to comply with the above requirements.

You may use our Services only as permitted by applicable law, including export control laws and regulations.

Software

The Service allows you to download client software ("software") which may update automatically. As long as you comply with these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the software, solely to access the Services. To the extent any component of the Software may be offered under an open source licence, we’ll make that licence available to you and the provisions of that licence may expressly override some of these Terms. Unless the following restrictions are prohibited by law, you agree not to reverse engineer or decompile the Services, attempt to do so, or assist anyone in doing so.

Our rights

The Services are protected by copyright, trademark, and other laws. The trademarks, logos, domain names and any other similar signs or symbols which are displayed on the Website or as part of the Service are the registered and unregistered marks of Telenor and Telenor Software Lab AS. Nothing in the Terms grants you the right to use any such marks. These Terms do not grant you any right, title or interest in the Services, others' content in the Services, trademarks, logos and other brand features.

Copyright

By your use of the Service, we ask that you respect the intellectual property rights of others as we do. We respond to notices of alleged copyright infringement if they comply with the law. We reserve the right to delete or disable content alleged to be infringing and terminate accounts of repeat infringers.

Support

If you require assistance, please Mine Papirer support. Most questions will be answered within 24 hours.

Termination

You can request that Telenor Software Lab AS delete your account, including all content and data we hold about you. You may do so by contacting Mine Papirer support. It may take up to 30 days for us to complete this request.

If you act in breach of the Terms, Acceptable Use Policy, or applicable laws, your right to use the Service and access Your Content within it will immediately, without notice, terminate, or suspend without refund of any fees. We may also discontinue or stop providing the Service to you, or add limits to your use of the Service.

Where possible, we will provide you with reasonable advance notice via the email address associated with your account to remedy the activity and notify you of how to export Your Content from our Services. It is your responsibility to follow these steps in time. Please note that we delete Your Content 30 days after termination.

We may not provide notice before termination or an opportunity to export Your Content where:

  1. you're in material breach of these Terms;
  2. doing so would cause us legal liability or compromise our ability to provide the Services to our other users; or
  3. we're prohibited from doing so by law.

Disclaimer

The Service is provided "as is". You acknowledge that the Service is not error-free. We make no warranties, expressed or implied, with respect to the availability, merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, performance and quality of the Service. The Service will from time to time have to carry out updates and maintenance of the Service, due to technical, security or operational reasons, during which time the Service might be unavailable. Telenor Software Lab will make reasonable efforts to arrange updates and maintenance outside of peak usage hours. This does not override any legal protections, including statutory warranties, granted to consumers by EU law

The website and the Service may contain links to third party websites. These links are provided solely as a convenience to you and not as an endorsement of the contents of such third-party websites. The Service does not take responsibility for the content of linked third-party websites. You should carefully review the Terms of use and privacy statements of all websites that you visit.

Limitation of Liability

Except as otherwise required by law, we (including, our affiliated companies, partners and their contractors, officers, directors and employees) shall have no liability for damages under these Terms, howsoever caused whether arising under law, contract, warranty, indemnification, tort or otherwise, including, without limitation, incidental and consequential damages, loss of profits or business opportunities, or damages resulting from loss of data or loss of access to the Service. In any event, Telenor Software Lab's total liability shall not exceed the amount paid by you for the Service during the last 12 months prior to the incident that causes the liability.

Changes

We are constantly changing and improving our Service. We may add or remove functionalities, features, and content, and we may suspend or stop a Service entirely. We may also update or otherwise amend the Terms, for instance to reflect changes to the Service or changes to the law. The amendments will not have retroactive effect. We will publish any amended Terms on the website. Material changes will be notified more prominently to the e-mail you are registered with. The amendments will enter into force when published on the website or otherwise when communicated to you in an appropriate manner. Your continued use of the Service after such publication or notification is considered as an acceptance of the amended Terms. We encourage you to check the website regularly. If you do not agree to the amendments, you should discontinue your use of the Service. We are entitled, in whole or in part, to assign our rights and obligations under the Terms to a third-party at our own discretion.

Resolving Disputes

We will try to resolve any questions or concerns you may have following your contact to our Mine Papirer support team.. Should we not be able to reach an acceptable resolution fo both parties, you or we may file judicial proceedings. Except where otherwise required by law, these Terms shall be governed by and interpreted in accordance with Norwegian law. Any dispute, controversy or claim arising out of or in connection with the Terms shall be subject to the jurisdiction of the Norwegian courts with the district court of Asker & Bærum, Norway as the legal venue.
